Information on the processing of personal data pursuant to art. 13 Legislative Decree no. 196/2003 and following the entry into force of EU Regulation no. 679/2016

The purpose of this document is to inform the natural person (hereinafter “Interested”) regarding the processing of his personal data (hereinafter “Personal Data”) collected by the data controller, Moka Productions, Via Basilio Bricci 27, 00152 Roma, VAT n.  013065241005, e-mail info@giglioinfo.it, (following “Owner”), through the website / application giglioinfo.it (following “Website”).
Changes and updates will be binding as soon as they are posted on the website. In case of non-acceptance of the changes made to the Privacy Policy, the interested party is required to cease using this website and may request the Owner to cancel his Personal Data.

1. Types of personal data processed​

The processing of Personal Data is carried out using paper and IT tools with organizational methods and with logic strictly related to the purposes indicated and through the adoption of adequate security measures.

Personal Data is processed exclusively by:

  • persons authorized by the Personal Data Controller who are committed to confidentiality or have an appropriate legal obligation of confidentiality;
  • subjects who operate independently as separate data controllers or by subjects designated as data processors by the Data Controller in order to carry out all the processing activities necessary to pursue the purposes referred to in this information (for example, commercial partners, consultants, IT companies , service providers, hosting providers);
  • subjects or entities to which it is mandatory to communicate Personal Data by law or by order of the authorities.

The subjects listed above are required to use the appropriate safeguards to protect Personal Data and can only access those necessary to perform the tasks assigned to them.

Personal Data will not be disseminated indiscriminately in any way.

2. Cookies and similar technologies

The website uses cookies, web beacons, unique identifiers and other similar technologies to collect Personal Data of the interested party on the pages, on the links visited and on the other actions that are performed when the interested party uses the website. 3. Legal basis and purpose of the processing

The processing of Personal Data is necessary:
  • for the execution of the contract with the interested party and precisely:
    1. fulfilment of any obligation deriving from the pre-contractual or contractual relationship with the interested party
    2. registration and authentication of the interested party:to allow the interested party to register on the website, access and be identified also through external platforms
    3. support and contact with the interested party: to respond to requests from the interested party
    4. payment management: to manage payments by credit card, bank transfer or other instruments
  • by legal obligation and precisely:
    1. fulfillment of any obligation established by current regulations, laws and regulations, in particular, in tax and fiscal matters
  • on the basis of the legitimate interest of the Data Controller, for:
    1. email marketing purposes of products and/or services of the owner to directly sell the products or services of the owner using the email provided by the interested party in the context of the sale of a product or service, subscription to the newsletter or to contact a customer who promotes his business on the website.
    2. management, optimization and monitoring of the technical infrastructure: to identify and resolve any technical problems, to improve website performance, to manage and organize information in a computer system (e.g. server , databases, etc.)
    3. security and anti-fraud: to guarantee the security of the Owner’s assets, infrastructures and networks
    4. statistics with anonymous data: to carry out statistical analyzes on aggregated and anonymous data to analyze the behavior of the interested party, to improve the products and/or services provided by the Data Controller and better meet the expectations of the Interested
  • on the basis of the consent of the interested party, for:
    1. retargeting and remarketing: to reach the interested party with a personalized advertisement who has already visited or has shown interest in the products and/or services offered on the website using his/her Personal Data. The interested party can opt-out by visiting the page of the Network Advertising Initiative
    2. marketing purposes of the Owner’s products and/or services: to send commercial and/or promotional information or materials, to carry out direct sales of the Owner’s products and/or services or to perform market research with automated and traditional methods
Based on the legitimate interest of the Data Controller, the website allows you to interact with external platforms or social networks whose processing of Personal Data is governed by the respective privacy policies to which please refer. The interactions and information acquired from this website are in any case subject to the privacy settings that the interested party has chosen on these platforms or social networks. This information – in the absence of a specific consent to the processing for further purposes – is used only to allow the use of the website and to provide the information and services requested. The Personal Data of the interested party can also be used by the Data Controller to protect himself in court before the competent judicial offices.

4. Processing methods and recipients of Personal Data

5. Place of data processing

If necessary, Personal Data may be transferred to subjects located outside the territory of the European Economic Area (EEA). Whenever the Personal Data were to be transferred outside the EEA, the Data Controller will adopt all suitable and necessary contractual measures to guarantee an adequate level of protection of the Personal Data, including – among others – agreements based on the standard contractual arrangements for data transfers outside the EEA, approved by the European Commission. 6. Duration of retention of personal data

Personal Data will be kept for the period of time necessary to fulfill the purposes for which they were collected, in particular:
  • for purposes relating to the execution of the contract between the Data Controller and the Data Subject, they will be kept for the entire duration of the contractual relationship and, after termination, for the ordinary limitation period of 10 years. In the case of judicial litigation, for the entire duration of the same, until the exhaustion of the terms of practicability of the appeal actions
  • for purposes relating to the legitimate interest of the Data Controller, they will be kept until such interest is fulfilled
  • for the fulfillment of a legal obligation, by order of an authority and for legal protection, they will be kept in compliance with the timescales established by said obligations, regulations and in any case until the limitation period established by the regulations in force is completed
  • for purposes based on the consent of the interested party, they will be kept until the consent is revoked
At the end of the retention period, all Personal Data will be deleted or stored in a form that does not allow identification of the interested party.

7. Rights of the data subject

Interested parties can exercise certain rights with reference to the Personal Data processed by the Data Controller. In particular, the interested party has the right to:

  • be informed on the processing of their Personal Data
  • withdraw consent at any time
  • limit the processing of your Personal Data
  • object to the processing of your Personal Data
  • access your Personal Data
  • verify and request the rectification of your Personal Data
  • obtain the limitation of the processing of your Personal Data
  • obtain the cancellation of their Personal Data
  • transfer your Personal Data to another holder
  • lodge a complaint with the supervisory authority for the protection of your Personal Data and/or act in court.

Contact Form

Once you have filled in and sent a contact form, the personal information that you provided will be processed by the person responsible under privacy laws in order to answer your inquiry based upon the consent you have given by submitting the contact form. There is no legal or contractual obligation to provide personal information . Choosing to not provide personal information simply means that your inquiry will not be sent to us and we will not be able to process it. You have the right to withdraw your consent in writing at any time form. This withdrawal of consent shall have no impact on the legality of data processing activity up to the point in time when consent was withdrawn.
Further processing of the data which is consistent with the original purpose of processing on the same legal basis for the purpose of direct marketing in forms not subject to consent, including for example the addressed postal delivery of advertising, is carried out until consent is revoked. In that case, the data is forwarded to the shipping provider. You have the right to revoke your consent to the use of your personal information for the purpose of direct advertising at any time; for details, see the rights of the affected party below. If consent is revoked, your personal information will no longer be processed for the purpose of direct advertising.

E-Mail Newsletter

By checking the box, you agree to the aforementioned personal information being used by the person responsible under privacy laws to send you current information and offers by e-mail newsletters until your consent is revoked. There is no legal or contractual obligation to provide personal data. Not providing personal data will only result in you not receiving the e-mail newsletter. You have the right to withdraw your consent at any time in written form or by clicking on the unsubscribe link in the e-mail newsletter. This withdrawal of consent shall have no impact on the legality of data processing activity up to the point in time when consent was withdrawn

Booking Data

During the search for your accommodations or other services we will need personal information provided by you, such as your name and the names of those traveling with you, you e-mail address, and your payment information. When booking accommodations or services, we may ask for your address, phone number, date of birth, and possible preferences. We ask that you provide health-related information by telephone.

The purpose of transferring your information is to complete your bookings with your accommodations or service of choice and to convey your information to the respective providers. Your information will be provided to the people supporting us if necessary for the completion of the booking. We do not sell or rent out your information.

As a rule, you usually do not book an accommodation or service just for yourself, but also for companions whose information you also provide us at the time of booking. This is also the case if you make a booking for someone else. In some cases, you may use our platform to share information with others (such as with referral programs). Information on the data processing is listed separately there. We hereby inform you that it is your own responsibility for the people whose personal information you have provided to us to have correspondingly agreed to this.

Providing personal information within the framework of bookings is necessary because otherwise, the agreed upon services cannot be provided. The legal basis for the aforementioned data processing is the fulfillment of the agreed upon services for which the party is the affected person or else for which the processing fulfills a legal obligation (Art. 6, Sec. 1, subsec. b and c of the General Data Protection Regulation (GDPR). The data are processed and/or stored until they are no longer applicable.
